The thousandth complex entrepreneurial license (franchising) agreement is registered in NCIP

On October 9, 2023 the National Center of Intellectual Property (NCIP) registered the thousandth complex business license (franchising) agreement (franchise agreement). The party to the agreement is a Belarusian enterprise - JSC "Krasny pischevik", the main activity of which is the production of confectionery products (the organization already has about 40 registered franchise agreements on its account).

Over the last 5 years (2019 - October 2023), NCIP has registered 541 franchise agreements, which is more than half of the total number of registered franchise agreements (54.1%) since 2006.

In general, 2023 may become a record year in terms of the number of registered franchise agreements in 18 years (as of October 9, 2023, 125 franchise agreements have already been registered, while previously the most was registered in 2022 - 137). According to part 1 of Article 910 of the Civil Code of the Republic of Belarus, a franchising agreement is an agreement under which one party (the right holder) undertakes to provide the other party (the user) for a fee for a period of time specified in the franchising agreement or without specifying the period of time a license complex, including the right to use the brand name of the right holder, other intellectual property objects provided for in the franchising agreement, as well as undisclosed information in the entrepreneurial activity of the user.

Such agreement shall be subject to registration with the patent authority (clause 2 of Art. 2 of the Franchise Agreement).

One of the most popular Belarusian franchises is a chain of coffee shops "Coffee Sound". They have about 150 registered franchise agreements in the period from 2018 to October 2023 (15% of the total number).
