Peculiarities of interaction between the customer and the contractor under a contract for the creation of complex copyright objects

The second edition of the journal «Intellectual Property in Belarus» published an article by Nadezhda Shakel (Candidate of Legal Sciences, Associate Professor, Senior Lawyer of Stepanovsky, Papakul and Partners. Legal Services») «Peculiarities of interaction between the customer and the contractor under the contract for creation of complex copyright objects».

The author considers the issues of creation of copyright objects (especially complex, multicomponent, complicated, such as multifunctional software or websites) by request within the framework of realization of the contract for performance of works (rendering of services) in the context of amendments to the Civil Code of the Republic of Belarus (2024). The complexity of such contracts requires increased attention from the parties when concluding them. Also the new provisions of the civil legislation, to which the parties will need to pay attention when implementing their contractual relations, have been analyzed. The authors propose options for solving some problems, taking into account the need to find a balance of interests of all parties, as well as practical aspects of the relevant activities.
