On January 4, 2021, the Head of State signed the Law of the Republic of Belarus “On Ratification of the Treaty on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union” (hereinafter – the Law).

The adoption of the Law is aimed at completing the domestic procedures necessary for the ratification by the Republic of Belarus of the Treaty on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union (hereinafter – the Treaty), signed in Moscow on February 3, 2020.

The Treaty is aimed at regulating relations arising from the registration, legal protection and use of trademarks and appellations of origin of goods of the Eurasian Economic Union (hereinafter – the EAEU).

The agreement, in particular, provides for:
Submission of one application for an EAEU trademark to any of the national patent offices of the member states and one application for an appellation of origin of the EAEU goods to any of the national patent offices of the member states;
Interaction of the applicant with only one office of filing on the principle of “One-Stop Service”;
Obtaining a single title of protection (a certificate for the EAEU trademark, a certificate of the right to use the EAEU appellation of origin), valid in the territories of all member states;
Maintaining the Unified Register of Trademarks and Service Marks of the EAEU and the Unified Register of Appellations of Origin of Goods of the EAEU.

The implementation of the Treaty will simplify and facilitate the procedure for obtaining legal protection for trademarks and appellations of origin of goods, which is valid simultaneously in the territory of all EAEU member states, as well as reduce the costs of applicants and right holders including Belarusian manufacturers, and ensure free and protected turnover of their goods and services on the EAEU market.

The state institution “National Center of Intellectual Property” has been designated as the organization of the Republic of Belarus responsible for the implementation of the Treaty in accordance with the Law.
