From February 19 to 21, 2020, specialists from the National Center of Intellectual Property took part in a meeting held by the Eurasian Economic Commission (hereinafter referred to as the EEC) to finalize the draft Instructions to the Treaty on Trademarks, Service Marks and Appellations of Origin of the EAEU.

The meeting was also attended by the representatives of the Republic of Armenia, the Kyrgyz Republic, the Republic of Kazakhstan, the Russian Federation and the EEC.


On February 3, 2020, the Treaty on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union was concluded. The agreement provides an opportunity to register a trademark, a service mark or an appellation of origin of goods at the same time on the EAEU member states territories by submitting one application. Such an application will be submitted either in the form of an electronic document through a single portal posted on the official website of the EAEU, or in the form of a paper document directly or by mail.

The instruction is developed in accordance with Article 26 of the Treaty on Trademarks, Service Marks and Appellations of Origin of the EEU goods. It contains the rules needed for the implementation of this Agreement, as well as standard forms of documents.

During the meeting, agreed decisions were developed on the relevant language of the draft Instructions, including the possibility of providing legal protection for indications representing a color or a combination of colors.

Moreover, a draft list of types of legal actions in relation to the registration, legal protection and use of trademarks, service marks of the EAEU and appellations of origin of the EAEU and the rates of patent fees for committing such legal actions were considered during the meeting.

Legal actions and the size of patent fees for their implementation will be approved by a decision of the EEC Council and enshrined in the legislation of the EAEU Member States.

In June 2020, the EEC board is planning to consider the draft Instructions and the draft list of types of legal actions and patent fee rates for committing such legal actions. Then these projects are planned to be submitted for approval to the EEC Council.
